Terms and Conditions for Easy Mining Service

1.1 Service Provider: The Easy Mining Service ("Service") is provided by Vision Dealers s.r.o. ("we," "us," or "our"), registered in the Czech Republic with company ID 1107526. Our registered office is at Ricni 456/10, Mala Strana, 118 00 Prague 1, Czech Republic. The Service is operated in compliance with Czech legal regulations.

1.2 Nature of Service: We facilitate access to simplified cryptocurrency mining by acting as an intermediary for users to purchase hashing power through licensed and compliant platforms, adhering to all relevant regulations under Czech law.

1.3 Third-Party Involvement: Our Service relies on external providers for hashing power and mining pool services. By using our Service, you acknowledge that third-party terms may apply to these functionalities. We ensure that our third-party partnerships are in compliance with applicable Czech and EU laws.

2.1 Age and Capacity: By using the Service, you confirm that you are at least 18 years old and have full legal capacity to enter into a binding agreement in accordance with the Civil Code of the Czech Republic.

2.2 Compliance with Laws: You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in the Czech Republic and your jurisdiction.

2.3 Account Registration: You must create an account with us to access the Service. You are responsible for maintaining the security of your login credentials and for all activities under your account. Your personal data will be processed in accordance with Czech Act No. 110/2019 Coll., on the Processing of Personal Data, and other relevant privacy laws (see our Privacy Policy).

3.1 Mining Packages: We provide access to predefined mining packages. Each package specifies the type of cryptocurrency to be mined, hashing power, mining duration, associated fees, the mining algorithm, the price of the package, mining speed, estimation of global speed for the specific algorithm, probability of validating a single block, and the amount of blockchain rewards.

3.2 Hashing Power Purchase: All hashing power is procured through trusted third-party providers and directed to the Easy Mining pool. Once the package is selected and the order is placed, we provide you with details regarding the start time, lifetime, approximate remaining time, price, and the amount of committed hashing power.

3.3 Rewards and Outcomes: Mining rewards depend on successful block validation on the blockchain. We do not guarantee that any block will be validated or that you will receive a reward. Should a block be validated, you will receive the blockchain reward (after applicable fees) subject to blockchain protocols and maturation time.

3.4 Acknowledgement: PLEASE NOTE THAT MINING DIGITAL ASSETS IS HIGHLY COMPETITIVE AND SPECULATIVE. NO GUARANTEE IS MADE THAT YOU WILL VALIDATE A BLOCK OR EARN A REWARD. YOU ARE ADVISED TO EXERCISE CAUTION AND ENSURE ADEQUATE TECHNICAL RESOURCES AND KNOWLEDGE.

4.1 Registration: The registration of your account is completed via our platform. You are required to provide an email address and password. A confirmation email will be sent, and your account will be activated upon confirmation.

4.2 Account Creation Obligations: You agree to:

• Use a strong, unique password and update it regularly;
• Implement appropriate measures to secure access to your email and device associated with your account;
• Maintain the security of your account by safeguarding your login credentials;
• Promptly notify us of any suspected security breaches; and
• Accept full responsibility for any activity under your account.

4.3 Losing Access: Loss of access to your registered email may result in the loss of your account. Changing your email may require additional identity verification (KYC).

4.4 Custodian Wallet: We do not provide custodial wallets. All earnings must be sent to an external wallet of your choice.

4.5 KYC Process: You may be required to complete a KYC (or KYB for legal entities) procedure before accessing certain features. Failure to complete this process may result in account termination.

4.6 Security Notice: We strongly recommend enabling two-factor authentication (2FA). Loss or change of your 2FA credentials may require additional identity verification.

4.7 Third-Party APIs: Our platform may integrate third-party APIs to facilitate service access. However, the management of earnings remains your responsibility.

5.1 Service Fees: All fees for using the Service are clearly displayed before purchase. Fees include applicable third-party service charges and our facilitation fee in compliance with Act No. 634/1992 Coll., on Consumer Protection.

5.2 Payment Method: Payments must be made in Bitcoin. You are responsible for ensuring sufficient funds before initiating a transaction.

5.3 Non-Refundable Transactions: All transactions are final and non-refundable, except as required by Czech consumer protection laws.

6.1 Volatility and Loss: Cryptocurrency mining and associated transactions come with inherent risks due to price volatility, network disruptions, and regulatory changes. By using the Service, you acknowledge these risks.

6.2 Third-Party Risks: As our Service relies on external providers, disruptions, errors, or failures on their part may impact your experience. We are not liable for losses caused by such events.

6.3 Easy Mining Profitability Risk: The profitability estimates provided on our Platform are for informational purposes only. There are risks that actual earnings may differ from the estimates, and you may experience lower than expected returns.

7.1 No Warranties: The Service is provided on an "as-is" and "as-available" basis, with no guarantees regarding its reliability, availability, or suitability.

7.2 Limited Liability: To the maximum extent permitted by law, our liability is limited to the amount you paid for the Service in the preceding 30 days.

7.3 Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of the Service.

8.1 Ownership: All intellectual property rights related to the Service, including its design and underlying technology, are owned by us or our licensors.

8.2 License: We grant you a non-exclusive, non-transferable license to use the Service for its intended purpose. Unauthorized use may result in legal action.

9.1 Termination by Us: We may terminate or suspend your access to the Service at any time, for any reason including a breach of these Terms.

9.2 Termination by You: You may stop using the Service at any time by discontinuing your account.

9.3 Effect of Termination: Upon termination, your access to the Service will cease and any remaining funds (less applicable fees) will be returned.

10.1 Right of Withdrawal: As a consumer, you have the right to withdraw from this agreement within 14 days without providing a reason, except for fully performed services with your explicit consent.

10.2 Complaint Procedure: If unsatisfied with the Service, you may submit a complaint, which we will address promptly in accordance with Act No. 634/1992 Coll.

10.3 Alternative Dispute Resolution (ADR): Disputes may be resolved through an ADR body. For Czech consumers, please contact the Czech Trade Inspection Authority at www.coi.cz.

10.4 Consumer Awareness: By using our Service, you acknowledge that cryptocurrency mining is speculative and involves significant risks.

11.1 Taxes in General: It is your responsibility to determine and pay any taxes applicable to your transactions or services. We are not liable for any tax obligations or advice in this regard.

11.2 Value Added Tax (VAT): Should VAT be applicable, it will be added on top of the fees you owe to us. You may be required to provide your VAT identification number.

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of the Czech Republic.

For consumers residing in the EU, additional rights apply:

13.1 Changes to Terms: We reserve the right to amend these Terms at any time. Changes will be effective immediately upon posting on our website.

13.2 Notice of Changes: You will be notified of any significant changes in accordance with Section 1752 of the Civil Code.
